[2006-06-01] Indonesia - Application Procedures for the Registration of Integrated CircuitsThis Government Regulation, No. 9 of 2006, has been issued to facilitate the implementation of provisions contained in Article 10(7) of Law No. 32 of 2000 on Integrated Circuit Designs.
Registration applications are required to be submitted to the Directorate General in triplicate. The actual format of the application form is to be determined and confirmed by the Directorate General and will be required to be submitted in Indonesian. Nevertheless, the standardized form will require the applicant to supply complete names and addresses for the designer of the integrated circuit, the name of the applicant, any Power of Attorney, and the date of commercial exploitation of the design if this has already occurred.
The application process will also require the submission of drawings or photographs of the integrated design, a statement declaring the design is original and owned by the applicant or the designer, and evidence of payment of any requisite fees. Applications can only be made for one integrated design per application.
In the event that the applicant lives outside of the territory of Indonesia, then the application must be filed under power of attorney by someone resident in Indonesia. The date of receipt will be stamped on the completed application. It is important to note that receipt will not be acknowledged until the application is complete. In the event that the application is not complete it will be returned to the applicant, the applicant then has 3 months to complete the form. This period may be extended for a further 1 month on request.
Any withdrawal of the application must be addressed to the Directorate General and must be in writing. Within a period not exceeding 2 months from the date of receipt of the complete application must issue an integrated design certificate.
Any integrated design certificates issued prior to this Regulation remain in force so long as they do not conflict this Regulation.
