[2005-06-28] Bahrain - adopts the Eighth Edition of the Nice Classification of Goods/Services

On 28 June 2005, the Bahraini Trademark Office adopted the Eighth Edition of the international classification of goods/services, by which class 42 was divided into 42-45. Consequently, the Bahraini Trademark Office will start accepting trademark applications for services that fall under classes 42 to 45 according to the following procedures: - Applications for trademark registration under the new international classes 42 to 45 shall be immediately accepted. Applications under class 42 shall not be accepted unless they include services classified under the eighth edition. - Class related to applications, which have already been filed under class 42, and are still under examination and have not yet been published, can directly be amended at the Trademark Office without any fees. - Applications that have been published, or are currently in the process of being published (publication fess were paid), shall undergo no change until the registration process is completed. After that, such applications shall be treated the same as registered trademarks. - Registered trademarks shall be dealt with as per the new classification, according to the following cases: • If all services pertain to only one class of the new classes, except for class 42, an application should be submitted by the owner of the mark or his agent to change the class number to the new one. • If services pertain to ‘All services included in Class 42’, the owner or his agent shall specify the services by submitting an application for amending the services to determine what class the trademark claims. • If services include different services, some of which pertain to class 42, while others pertain to other classes, an application to amend the services should be submitted, so as to delete any services and to comply with the new class. - There shall not be any renewal for any trademark in class 42, unless it claims the correct services. - Applications for trademark registration in classes 42 to 45 shall be automatically examined. - A timetable shall be set to modify the status of trademarks that have been registered in class 42 before July 1, 2005, and of which the Ministry have not yet received any applications for their modification.
