Summary

Congo is a member of the Paris Convention for Protection of Industrial Property since the thirty first of January 1975. The international classification of goods and services for the purpose of registration of Trade marks is followed in Congo.  An application includes goods and/or services in three classes and an additional fee to cover the classes after the third class.  Once a trademark application is filed, an official filing receipt is issued indicating a provisional filing number and the filing date.  Trademark applications are not examined as to their registrability, against prior registration, except when an availability search is requested by the applicant. The registration certificate is issued after completing all the filing requirements.

 

A Trademark is valid for ten years from the date of filing the trademark application.   Thereafter, a trademark registration is renewable for periods of ten years upon application and payment of the renewal fees.  A grace period of six months is allowed for late renewal of a trademark registration.



Requirements

FILING REQUIREMENTS

 

1. A simply signed power of attorney in duplicate for each application. Powers of attorney are printed by the administration.

2. A printing block and twelve prints of the mark

3. The list of goods to be covered

4. A certified copy of the priority document must be submitted within a period of six months incase it is claimed.

 

ASSIGNMENT APPLICATION

 

1. A simply signed power of attorney printed by the administration, in duplicate.

2. A deed of assignment signed by the assignor duly legalized up to the Congolese Embassy or consulate.

3. The original registration of the trademark.

 

CHANGE OF NAME AND ADDRESS

 

1. A simply signed power of attorney printed by the government, in duplicate

2. A certificate of change of name or address simply signed by a public authority.

3. The original registration certificate of the trademark.

 

LICENCE APPLICATION

 

1. A simply signed power of attorney printed by the administration, in duplicate

 

2.  A legalized license agreement executed by both parties

 

3.  The original registration certificate of the trademark
