Summary

Step 1

 

You will be required to appoint an agent within the jurisdiction.  We will be happy to forward our form of power of attorney at the time of referral or immediately upon your instruction for us to apply for trademark registration. 

 

Step 3

Advertise in the Official Gazette for one month.

 

Mark Already Registered in the United Kingdom

If a trademark has already been registered in the United Kingdom, the laws here allow for re-registration of the mark without the need for the usual advertising process.  The re-registration allows the mark to remain in effect as long as the mark is effective in England.

 

An application to re-register a UK mark in Anguilla will only require:

A.  The authorisation of agency form, and

B.  The original or a certified copy of the original Certificate of the UK entry.

You will be pleased to note that relatively recent legislation came into force in Anguilla effective August 12th 2002. 

The new trademark laws comply with the WTO's Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), and features the following:

1.  Adoption of the Nice International Classification

2.  Claiming of priority under the Paris Convention

3.  The period of registration is now 10 years with renewal periods of 10 years each

4.  Provides for the protection of well known trade marks

5.  Protection is extended to shapes of packages

6.  Notarization of application forms for registration and powers of attorney will no longer be required.

The new legislation keeps the dual system of registration. The application process is also being streamlined in keeping with best current international practice. The legislation also allows us to make the application for registration immediately, and to thereafter submit the Power of Attorney to the registry. We enclose for your attention a copy of the Power of Attorney, Scale of Fees and Trademark information sheet for your information and guidance.

Please be advised that the new Patent Regulation, 2004 is in the process of being passed as legislation.  Once the regulation has been passed we would be in a better position to advice on the new official fees. Please find enclosed the Power of Attorney along with Application form.  

 

 



Requirements

Provide us with the following:

 

A.  The name, address and nationality of the applicant,

B.  A description or reference to a description of the mark, six logos if applicable, a translation or transliteration if applicable,

C.  The class (es) for which the registration is required (Nice classification), and

D.  Whether priority is claimed.

 

An application to re-register a UK mark in Anguilla will only require:
